The crash happened late Sunday morning in the area of 300 Boston Post Road East, which is Route 20.

Andy Lopez, 19, was arraigned Monday afternoon in Marlborough District Court and held on $5,000 bail.

The victim, identified by family as 12-year-old Dominick Matos, suffered a fractured skull and had to have surgery for a brain bleed.

Assistant District Attorney Mary Rose Dobson said Dominick had bought a gallon of milk before he was hit, and that milk helped investigators make an arrest.

“Child that was struck was carrying a gallon of milk. And there was milk sprayed all over the defendant’s vehicle as he drove away,” she said.

Investigators said the boy’s hair was found on Lopez’s SUV.

Dobson said Lopez told investigators his car had been damaged by a tree limb and he had already called his insurance company about it.

A friend witnessed the car approaching “faster than the speed limit on the street” and then the crash.

“I ran to him, I just dropped my moped, I just dropped it and I just ran to him. He was unconscious, he wouldn’t move, he wouldn’t … his eyes wouldn’t open, nothing,” said Adriel Mercado. I don’t even know if he was alive.”

Dominick’s mother said he was expected to be in the hospital for at least a month.

“He was playing football yesterday, and now he’s laying in a hospital bed where he’ll probably be for a long time,” Dominick’s aunt Cheryl Parks said.

Police shared photos of the suspect vehicle, which is believed to be a gray or light green SUV, possibly a Toyota Highlander.

According to police, the vehicle fled west down Route 20 after the crash and took a right turn into the back entrance of Ghiloni Park at approximately 11:47 a.m.

Jordan Caban, Dominick’s best friend since kindergarten, says he’s angry at the driver. “I feel like they should turn themselves in.”
